UPDATE: Sitter convicted in baby's death will appeal

BARABOO, Wis. (AP) _ The baby sitter found guilty in Sauk County of killing an infant in her care plans to appeal her conviction.

Jeanette Janusiak, of Reedsburg, was found guilty last month in the death of 4-month Payten Rain Shearer. The Baraboo News Republic says the woman's attorney has filed paperwork in Sauk County Circuit Court of her intent to appeal the first-degree intentional homicide conviction.

The 27-year-old woman was sentenced life in prison with the possibility of parole in 40 years.

Medical experts testified at trial that the child had been severely battered around the same time that Janusiak called 911.

Jeanette Janusiak has written a letter to the sentencing judge, Patrick Taggart, asking for the possibility of parole at the earliest date allowed under the law. 

The 27-year-old Reedsburg woman insists she was wrongly convicted of first-degree intentional homicide in the death of Payten Rain Shearer, the 4-month-old daughter of her best friend. Janusiak will be sentenced July 14.

The Baraboo News Republic says Janusiak told the judge she will continue to proclaim her innocence and believes ``the truth will one day prevail.''

BARABOO, Wis. (AP) _ A baby sitter on trial for homicide in Sauk County says she never accidentally dropped the infant she's accused of killing.

Prosecutors say Jeanette Janusiak's testimony contradicts the statement she gave to detectives following the 2011 death of 4-month-old Payten Rain Shearer.

The 27-year-old Reedsburg woman testified under questioning by her attorney Tuesday that she initially told police she dropped the child because she was scared and feared she would go to jail.

Janusiak says she called 911 after she awoke to the sound of the baby gagging and vomiting. The Baraboo News Republic reports medical experts agree the child had been battered by someone, and died as the result of severe head wounds.
