MADISON (WKOW) — Gov. Tony Evers is planning to modify the state’s involvement in a lawsuit to repeal the affordable care act. Evers said Wednesday he will send a letter to Attorney General Josh Kaul calling for the state the change it’s “stance” in the multi-state lawsuit that aims to eliminate the health care law.
Last month Republicans passed a law during the lame duck session making it illegal for Evers or Kaul to remove the state entirely from the lawsuit.
“We will issue that letter directly to the attorney general and we believe it will be in such a format that he (Kaul) will be able to move forward on my request,” said Evers.
Evers did not explain further on how he wouldn’t violate any of the new laws.
“You’ll have to wait and see the letter,” he said.
Kaul reiterated in a statement his office will review the request and take appropriate action in accordance with the law.
“Insurance companies shouldn’t be able to discriminate against Wisconsinites with pre-existing conditions,” Kaul wrote.
Former Republican Attorney General Brad Schimel joined the lawsuit months ago to repeal the Affordable Care Act and in December a federal judge ruled the ACA unconstitutional. Despite the ruling, the ACAC will remain intact because the judge did not prevent federal officials from enforcing it.
