The case against a 15-year-old accused in the Shay Watson homicide will move forward after a judge found probable cause Thursday.
There was a preliminary hearing in Dane County court via video conference.
The teen's defense made a motion to dismiss the charges, but the court denied that.
A Fitchburg police detective was called as a witness.
"During the struggle, a firearm was produced by [the suspect,]" said Det. Matthew Wiza. "He shot Shay Watson as he was returning to the access door to the residence."
Watson, 17, was a student at Verona High School. Authorities previously said he was shot in the back of the head, after a drug deal gone wrong.
The defense is asking for the case to be moved to juvenile court, as the suspect is 15 years old.
The teen will be back in court at the end of July.
