Son of Waukesha Parade Killer Gets Plea Deal Day After Father's Conviction

The teenaged son of Waukesha Parade killer Darrell Brooks, Jr. reached a plea deal in connection with an attempted suicide the day after Brooks was convicted, "The Dan O'Donnell Show" has learned exclusively.

Xavier Brooks, 19, had been charged with three felonies and four misdemeanors after holding a gun to his head and telling his mother he was going to kill himself earlier this year. On Thursday, the day after a jury convicted Darrell Brooks of all 76 charges he faced, Waukesha County Circuit Court Judge Paul Bugenhagen withheld an 18-month probation sentence for Xavier Brooks.

According to a criminal complaint, the younger Brooks was threatening suicide in February. He bit his mother's finger and attempted to take her cell phone when she called police. When officers arrived at the home a short time later, Brooks locked himself in the basement of the home and refused to come out. Eventually, he surrendered and was taken into custody.

Brooks was charged with felony counts of failing to comply with an officer, intimidating a victim through the use or attempted use of force, and intimidating a victim through damage to property as well as misdemeanor counts of criminal damage to property, disorderly conduct, and resisting or obstructing an officer.

Waukesha County Court Commissioner David Herring freed him from jail on $100,000 signature bond last February. Herring was the same court commissioner who freed Brooks' father just days before the Waukesha Parade even though the Waukesha County District Attorney's Office requested that he be jailed for non-payment of child support. Xavier Brooks' mother is the woman whom Darrell Brooks had failed to pay.

The younger Brooks agreed to undergo months of intensive mental health treatment and his mother, his alleged victim in the case, wrote a lengthy letter to Judge Bugenhagen pleading for leniency for her son. On Thursday, Bugenhagen accepted a plea deal with prosecutors in which Brooks pleaded guilty to the failure to comply charge. All other charges against him were dismissed but read into the record.

As part of the plea deal, prosecutors requested that Brooks' record be expunged. Judge Bugenhagen agreed pending completion of the withheld 18-month probation sentence.

It is unclear what if any relationship Xavier Brooks has with his father, who was convicted on six counts of first degree intentional homicide and 70 other felonies Wednesday following a three-week trial. He killed six people and injured dozens of others when he drove his SUV through the Waukesha Christmas Parade last November.

Darrell Brooks faces a mandatory term of life in prison when he is sentenced.
