Madison man accused in toddler's death facing 18 charges

MADISON (WKOW) — A Madison man accused in a toddler's death on the city's west side has been formally charged. 

Online court records show Marshawn Giles is facing 18 charges, including first-degree intentional homicide, first degree child sex assault, second degree sexual assault and multiple counts of battery. 

Giles was taken into custody April 25, the same day Madison police officers responded to an apartment on Schroeder Road around 2:45 a.m. to check on a woman who was screaming for help. She said a man killed her baby.

When officers got to the home, the 20-month-old girl was alive but seriously hurt. EMS rushed her to the hospital where she died. 

Initially, Giles was taken into custody in connection to child abuse charges stemming from a separate investigation involving the same family. 

Giles appeared in Dane County Circuit Court Monday, where a $1 million dollar bond was set.

A criminal complaint filed in Dane County Circuit Court Monday compiles a series of events together over the course of several days to result in the 18 charges.

Some of the events involve abuse of two other children in the home, and others involve abuse toward the toddler’s mother at the hands of Giles.

The children’s grandmother reported the abuse towards the children to police on April 18 after one was allegedly “snapped” in the eye and slapped across the face.

Four days later, on April 21, she contacted the police again, to report a domestic disturbance between her daughter and Giles. At this time, she also contacted Child Protective Services in an attempt to gain custody of the children “because of the dangerous situations they have been in recently.” A CPS social worker told police the children would not be removed from the home despite a physical abuse investigation as “it did not justify enough danger.”

On April 25, the toddler was the only child present at the Schroeder Road apartment. The complaint alleges the toddler’s mom picked her up from her grandmother’s on April 23, but left the other two children.

She told police, she and Giles traveled to Milwaukee earlier in the day, and he began “tweaking” on the way home. He reportedly threatened to kill her and threw her phone out the car window. The “tweaking” continued once home, and he sexually assaulted her and physically assaulted her and the toddler.

She said Giles threw the toddler from the bedroom into the bathroom, “threw her forcefully” into the open toilet and threw her into the bathroom before continuing to punch her.

Authorities found the child nude with a pillow over her face, but still alive. She died at a hospital despite efforts from first responders.

Her autopsy found blunt force trauma injuries to the head, including skull fractures, and evidence of sexual assault. Her cause of death is listed as blunt force injuries to the head, torso and extremities and manner as a homicide.
